Objections to Assessment Validation

One of our community members requested to see the copies of the assessment validation objections that had been submitted to the court. These objections are a matter of public record so they are being posted here for reference as well. I find it problematic that a person that had the road in front of their house treated for dust abatement by the district putting the recycled pavement down (notably at no charge to them), is now suing to stop anyone else from getting the same benefit!!!! That to me seems super selfish. First the board was being threatened to be sued by people wanting dust abatement, now others want to sue to stop it. Good gracious. I can understand that some might be cautious about a new project. Frankly, after a previous board did such a horrible job overseeing the previous road surfacing project and failed to make sure the contractor actually did it right and to even hold them accountable - I am cautious too. The community seemed on board for the (crappy) recycled pavement, but not otta seal? Whatever. All I want is Buckhorn ripped up and gravel put back down. If everyone wants dust all the time, so be it.

@ewolf97 this is the first I'm hearing of someone suing. Did I miss something?

The problem is the way the road project is being handled. It has to be done legally. In order to fund the road project by a bond it has to be voted on by the electors. Which is why I think we have spent the thousands of dollars on legal fees, the board and many others don't want it voted on because some of the homeowners who are in favor of otta seal wouldn't be able to vote because their home in Panoramic isn't their primary residence.

You can find the info on voting on a bond in the Oregon Revised Statutes, specifically ORS 255.085. The board cannot just decide to otta seal the roads because a vote was taken to "gauge" support and 70 homeowners were interested in improving the roads with otta seal. We have to vote on a bond, it's quite clear in the Oregon Revised Statutes. You and everyone in the Panoramic subdivision should want this done legally.

I was looking over the finances and so far, I have found that we have spent over $17k over the last year on the validation process, and that's all I've found so far. I am curious how much we have spent total on this project.

If the road improvement project is done legally and a vote on the bond passes, I will keep my mouth shut about the project. But until then, I cannot keep quiet. It's our money and we won't be told how to spend it unless it's done correctly.

I find it amusing that the only community members that can be correct or have a right to say anything are the ones for the project. Like I stated before, EVERYONE should want the road project done LEGALLY.

Lastly, I thought you didn't want it paved in front of your place any longer because of the wildlife. There is wildlife all along Panoramic. Perhaps otta sealing the entire subdivision will disturb wildlife.
