We will see how the meeting goes on Tuesday night. Elise said she will present information on what happened to Buckhorn she also said other bids would be presented. We, along with all of you and probably most of the community, hope for a less expensive proposal but something that would be guaranteed to last longer than what has been done already, Elise was also going to call Taylor NW and speak with someone about them possibly fixing Buckhorn as it was their work, per Elise, that led to the issues. Jim and Whitney, I did write above the answer to the two questions that Whitney asked about a ballot measure. It would be only those who have residency in Panoramic Estates that could vote on any ballot measure in Deschutes County. I (Kerry) feel certain that most renters would vote NO as they do not want their rents increasing. As far as splitting the work bid evenly among property owners, I was told that is possible but would take a vote of everyone to see what the consensus is. I spoke with Mr. Michael Lui. It sounds like that process could be lengthy. Our biggest concern is if the property owners want to pave in front of their own properties, or on the roads leading to their properties, us having liked the Otta-Seal and wanting the Otta-Seal, at some point down the road, if we choose to do that, or if the entire neighborhood votes for Otta-Seal, can it 'butt' up to the asphalt that will be laid? Elise if you see this, perhaps you can ask the person you mentioned having an appointment with on Saturday about bidding on the Buckhorn repairs.

That is a good question, Whitney. I have always felt that it should be the property owner who votes. Regardless, I think the purpose of the board is to assess and serve the majority of folks rather than just assuming that everyone wants paving.
I find it interesting that some people are upset about private landowners paying for road upgrades in the district. Nobody seemed to get upset when the north Lake Drive neighbors had to pony up over $20,000 to fix the roads (that are within the road district boundaries) because the road board at that time didn't want to take on maintenance of this section.
I have friends who live on Mountain View Road, way out at the Eastern extreme of Squaw Creek Canyon Estates. They drove a long dusty gravel road for years. and couldn't take it anymore. Recently after investigating options, including Otta Seal, they opted in favor of asphalt. The neighbors agreed to share the costs. Some paid more than others, one paid none. They got it done and it's a beautiful road with speed bumps, identified with snow plow poles.
They could do this because they are not an entity, just neighbors working together.
Panoramic, on the other hand, is a special district of Oregon with Board Members appointed by County Commissioners. It's a public road system. It is not legal for an individual or a group of people to affect change to these roads. The recent proposal by three homeowners to pave the section that serves them seems like a good idea, sort of. It sounds generous and was stated to be a benefit to over twenty households. The thing is, what's perceived as a benefit by some may not be a benefit to others. Believe it or not, some people made their home here because the roads are NOT paved. Kind of a rural rustic getaway from the mainstream? What if a group those folks decided to pool their money to remove pavement? There are differing opinions here. That is why we rely on a democratic process. I support whatever the majority votes for. A ballot measure in a real election has been and I think continues to be the most accurate way to determine what the majority of Panoramicans prefer. All other efforts to achieve a biased outcome are in my opinion corrosive to the principles of American democracy.
Oh, in terms of board bashing...this group of board members have been some of the most educated, caring, and interested we have had. The knowledge they all possess is substantial. Nyle is a kind and generous man, and has worked his rear off to try to do something that finally offers a long-term fix to our funky roads. In reality, to fix our roads we would need to lay down several layers of gravel bed on all of them, since none have much side berm. The Otta Seal was an option that would have reduced the loss of gravel, cut down dust, and reduced maintenance costs all for the SAME COST as doing all new gravel. But, perhaps future boards will come up with new solutions. New ideas. And, have the energy and willingness to be the punching bags that clearly board members must be here in our "community." It is sad that only the people who have negative things to say get on here.
Thanks Kerry for chipping in and helping pursue solutions to the roads. It would be great if you and Glenn could get the ballot measure going. I am hoping that through your efforts we can finally see something more than dirt. Please run for the board. A position will be open this year (maybe even two).

Yes it is a serious problem when the annual revenue for next year in total is only estimated to be $39,000. We are estimating carrying over approx. $26,000 from this years budget into next year or about 2/3 rds of this years revenue into next year.

You missed the whole point of the comment on driving on Buckhorn. I was not trying to be snide.
Okay, here we go again! WORD GAMES GUYS!!
Whitney point #1; What was the ONE bid that Nyle obtained for? VERY high if I recall. He then mentioned work would start in August, before the others, one of you, mentioned getting the three bids first. HENCE why we added a few other contractors to look at. SO Nyle did indeed mention a very large amount and had it scheduled prior to the meeting. HENCE concern from others, not just us.
Point #2 Logistics of the Ballot measure: There are logistical problems with pursuing any ballot measure right now. In particular: A. We don't have a consensus agreement on who will get to vote on any new project. B. We don't have a consensus on what type of funding would be used for the project. Until we come to an agreement on those issues we can't get an accurate read of support for any type of paving project.
NO, we do not have any consensus, NOR have your issues/points been discussed at a board meeting. How can an agreement be made if it is not discussed, Whitney? Let's just admit that it will not be on a ballot anytime soon, as Nyle is working on the other issue, for which we had better not have to pay a cent for it legally..
Jim's budget shows we have $65,208. Nyle's bid, and he did say it was scheduled for August before someone pulled back on the reins, was going to be $48,739.50. For 800' only of Buckhorn, Panoramic was not addressed and many people drive that road. Jim, to get to Hinkle Butte you must drive on Panoramic. We guess folks can turn left on Buckhorn and then Green Ridge Loop and avoid the worse part of Panoramic Drive and get to Hinkle Butte. Perhaps this will give them that idea. You were snide in your reply to Melody or the Johnson family as a whole. It does not matter WHAT roads we drive, the road maintenance of all roads is the responsibility of the road board. We do not need to be told how good or bad our roads are, as they are our roads in the Panoramic District. We believe that you and Whitney understand that and possibly Nyle does not. He has not once been on here to defend or speak to anything. The board ignored BuckHorn and Panoramic, as they (or Nyle) were sure the vote would pass. WHY could it be otta=sealed with the rest of Panoramic but must have a very expensive asphalt job now?
Asking for our thoughts then not really wanting them or not liking the wording someone may have used, is not a reason, to write in a snide or snotty way back. "The District is not allowed to print money so it has to do what it can with the money received." DO you really believe the Johnsons were stating to print money?!
If whoever they seek legal counsel from, at their own cost, states it is legal in writing that we can all see, NYLE has said on many SEVERAL occasions that things are legal without proof and not backed by either you Jim or Whitney at the meetings, something in writing and stating where and what law covers it AND also our big concern is how would otta-seal work butting up to asphalt if we choose to go that route someday, as that is what we were looking forward to.
Let's honestly work and get this on the ballot. Your reasons above make NO SENSE. It sounds like Nyle "speak" actually. I believe the cut-off date is October 10. I (Kerry) will take it upon myself and contact Deschutes County and ask if a ballot vote is held can out of area homeowners vote legally and leave renters out of the vote. From what I have read online, it is not possible unless someone can get the legislature or voters to amend the Oregon Constitution. However, I will follow up on that this week, hopefully, tomorrow, Monday 20 June.
Whitney, how are these usually funded when it goes to a ballot measure, with the increased taxes, correct? Yes, it would likely put the work out until 2023 or even later, but maybe prices would drop by then. I think after the primary's in the fall, our economy may start getting better.
Only time will tell and we can only hope that prices start dropping, as this is an insane economy to live in.
Happy Father's Day to you both. Not a day we need to be arguing on here. Obviously, we are not in agreement again. We hope that the two of you remain honest and show integrity in questioning some of Nyle's decisions. REALLY getting one bid and scheduling the job was crazy of him, and he does not think before he speaks either.
We personally would like to see Nyle resign, sooner rather than later.

Not to add to the fire in the comments but, please explain who “You” is. I did not make those statements you mentioned.
The District’s only source of money is the annual tax revenue. Please review the budget that has been presented at the last 2 meetings, you will see the district receives less than $ 40,000 next year. I agree grading, snow removal is important, so is fixing Buckhorn to the people that have to drive it.
Your statement of “Love the way you are out for the “Greater Good” If dial is correct you don’t have to drive Buckhorn and Hinkle Butte is in good shape.
The District is not allowed to print money so it has to do what it can with the money received.
Please work with the board and find solutions to the real problems.

Hello Jim, We are replying to your request. We were not at the meeting, but have read the minutes and listened to the recording. We feel as if the board (or at least Nyle) just wants to have their/his way. At the May meeting, the Ballot Measure was discussed by many, including Nyle. We and several others have stated that we would vote in favor of the Otta- Seal project if presented on a ballot. We wanted our value to be our own, not the split value that was put on the initial ballot that the Board chose. It seems as if the Board (again, or Nyle) are worried it will not pass and are not considering all of the new neighbors that did and would support it. We also do not want to see one cent of our remaining monies used on legal expenses brought on by this, now or in the future. Nyle states "initially" and we are unsure why he phrased it that way and what he means. That should be clarified. It sounds like he and whoever else are the neighbors considering this are talking asphalt. At some point, if this does go to a ballot measure, for otta-seal, as discussed, can otta-seal be connected to the asphalt that they may put in if it proves to be legal? Nyle has shown his true colors the last few months, with his way or no way....well, there is no other way, is there? We also agree with the Johnson family in their reply above. HOW can Buckhorn or Panoramic be repaired now with the minimal funds we have left in our Road Board account, and still maintain the roads that will not be worked on? "The District is charged with maintaining roads within the boundaries of the Panoramic Access Road District, which is a designated special tax district with the county." We truly feel that this road board (all or Nyle) has dug a great big hole for Panoramic to dig itself out of, with the vision of the roads being done one way, period. The challenges by the local resident started at least two years ago. This could have been taken care of two years ago, without all of the legal fees, as he stated every time he wrote something, that he supports the roads being done, in fact, he supported asphalt, but wanted it done on the ballot, per the residency requirements set forth by the supreme court. Many people in Panoramic likely own homes elsewhere, us included, we pay the taxes as they are voted on and we do not get to vote on anything there. That is our choice in keeping our home out of state. The people that do not live here, know the rules, as anyone owning property or vacation or rental homes anywhere in the USA would be aware of. We wish we could remember Bruce Bowen's reply on this in a meeting a few months back when it was being argued. He spoke very eloquently and was knowledgeable on the subject. He also said he supported the road improvement, just not the way the Board went about it. Whether or not the Road Board (and/or Nyle) agrees or disagrees, it is the law in Oregon and most US States, if not all. Your voting residence is the state you live in or the last residence you lived in if you leave the USA and want to continue voting as a US Resident. Right or wrong in anyone's opinion, it is the way voting was established many years ago. All of the Board Members during the last few years are intelligent people and are well aware of this. WE DID not get to vote on this way of voting for the roads, the Panoramic Road Board did that voting based on the opinions after meeting with the special road committee who far outnumbered others at the meetings, in person, and on zoom. Jim and Whitney, you both ran for the volunteer positions you are in and were not on the original push for the roads. We have so many questions and hopefully, some of them will be answered. In all of the three-member Board of Commissioners for Panoramic Road District, we have always seen the board members rotate positions. WHY is it that Nyle has remained the President and seems to do very little but direct others at the meetings? He is the least diplomatic of all of the Board Members/Commissioners over the last term since he joined the board. Not that diplomacy is a condition of being on the board, it probably is not, but thinking of the community as a whole is. Choosing to pave their own properties, may be legal, however, we do not want pavement at our property, never did, and is one of the main reasons we chose to live here twenty years ago. What precedent will this set for the future if others choose they want something else. We have always been told that you do not work on the roads in front of your home, that is the commissioner's responsibility. When we chose to purchase here, we had kids on bikes, motorcycles, and horses, and did not want, especially the horses, on asphalt. We like walking the dirt roads. When we went at the Board's request to look at the Otta Seal in the Sunriver area, with Jim's assistance, we reported back that it was much like it is now, with no cinder and no dust, but looked like rocks. We walked on it, walked our dogs on it, and drove on it. We also checked out the messes that were done in Bend. Where will this leave future boards if this proves legal, at the homeowners' who are choosing to do this, at their expense? Will it mean that we are all stuck with asphalt if future road improvements go fairly onto a ballot? If that is the case, we will fight it as we DO NOT want asphalt now or ever. It really is amazing that no one has filed a conflict of interest against Nyle as he and Lee had been told they could vote, but not verbalize (not looking up exactly what was said, but is on the website) their feelings on it due to their property values, they could possibly be seen as benefiting from this process. We never leave a meeting not knowing what Nyle wants. That is the truth. At the May meeting when he argued with several of us, or attempted to, about getting this on a ballot, which by the way there is still time to do, he finally mentioned maybe something to think about. He said it would not pass as it never had before. Kerry tried to talk about new homeowners since the last time this was voted on per Deschutes County Elections, he asked where we got our numbers. Nyle needs to resign in our opinion. He is not a great person to be a commissioner. He has initiated many arguments that have occurred over the last several years. He also received one bid for the asphalt repairs on Buckhorn and said they were to begin in August, without having the other two members agree on this or getting the required three bids. No voting was done unless the board is meeting prior and discussing all of these things. Some things have to happen that way, and when the special committee was established, which was never done in the past, that was understandable. Jim and Whitney, you were both leaders on that special committee and your time and work was appreciated. Again, what did Nyle do? He needs to explain what his comment was "initially" covering the legal fees. When does he not think he (they) should be held responsible? AND why? Again, rethinking the AWFUL Buckhorn and Panoramic Road conditions, do need to be looked at, but our roads need to be maintained also. HOW will that happen with the minimal funds that are remaining at the bid that Nyle received? We have looked up a few companies. will copy and paste it below, for a very long post! It does not always have to be the same one or two he gets bids from. There is a new licensed contractor in Sisters who does asphalt and crushed asphalt, but not otta-seal. Several companies do state they do otta- seal or similar. Are these Nyle's friends' companies that are always given the opportunity to bid? Also in the last meeting, there was some bashing of the last commissioners for not making the last companies repair the asphalt. Were we keeping up on it as we were supposed to? How much more damage was done by Nyle and other board members meeting with concrete (that we paid for at his rate) and concrete mixers, water, and manual labor of residents? That seemed to make it worse, not better, the few times we have driven that way. Jim your accounting is appreciated. We know you understand that all of this work cannot be done with the funds we have. When does the county cut a tax check to Panoramic? We do feel bad for the folks that must drive that way DAILY and are sure glad that we do not have to. Again, as someone said in the meeting recording, SLOW DOWN. There have been a few folks in the past that complain about those two roads who we have witnessed the way they drive on them. We are going to put the list in a separate post.
