A while back you asked what my Ballot Measure title would be. I wasn't sure. I waited for the voter's pamphlet to come out to see a current example of the right format. So here's my latest version I'll send to the County Clerk. Its format is copied from the Sunriver/Cloverdale ballot measures included in the current election Voter's Pamphlet so it should be ok, or close.
“Ballot Title: Panoramic Special Access Road District Ten-Year Local Option Levy
QUESTION: Shall the District levy a 10-year capital improvement tax to repair and pave District Roads at a rate of $.-- per $1000 of assessed value starting in fiscal year 2022/23?
This measure may cause property taxes to increase more than three per cent.”
As I understand it, once the title is approved and the estimated project cost is provided to the County, they will provide the amount for the “$.-- per $1000”, and the ballot title text can be finalized. The County then would also calculate for us the expected revenue from the levy in each year of the levy. All that info would then need to be summarized below the title and further describe the paving project that the funds would be spent on, similar to the summary in the current voter's pamphlet for the Sunriver or the Cloverdale Fire levy. Anyone can submit their arguments to the County for or against the levy for inclusion in the voter pamphlet.
Along the way a form needs to be filed before we could start to gather signatures. It's not very many signatures - 10% of the number of District voters who voted in the last election for governor. There are about 220 registered voters in Panoramic. Even if all of them voted last time only about 22 signatures would be required. I think the turnout was closer to 70% so I'm guessing about 15 will be required. The County Clerk would calculate it and tell us. Once the signatures are filed it triggers some notice requirements from the County to the District, and some normal gov't machinations along the way. One thing, if a committee is formed to raise money for or against (I'm not going to do that) a form with another hoop or two needs to be filed. Nothing too surprising or burdensome.
Once the County fills in the $.-- per $1000 of assessed value, District owners could than see what their property tax increase would be for those 10 years, and see their total balance if they prefer to pay lump sum. (If you do that I wonder if you get the 3% discount right now on the whole balance, anyone know?) After that all that's left is to vote and see what happens.

So it's ready to go for all practical purposes. We already have the engineering, material and cost estimates subject to any updates. We can't put a vote off forever, and costs are continuing to rise.
I believe there's a good chance the ballot measure could pass if the Board and all those who support paving could put our differences aside and turn our efforts toward that. There's also time to tweak the plan if necessary to broaden support if necessary. Whether or not it passes the District voters will have decided on this proposal. If it doesn't pass we'll have to fix and upgrade our roads as best we can with our annual base assessment and see if there is something more would support.
Those appear to be our choices now. The sooner we decide the better, there's still time to get it done in time for the September special election deadline.

Sounds like some more of the non factual stuff put out on the form.
In fact as I report previously in a board meeting. Both of the petitions he submitted to the country were rejected.
Jim, I do not know how he could have submitted it with the % per assessed value not completed. I just now wrote all of the past board members asking where the paperwork is at in regards to the last paving project. I am contacting the county after talking with them also. We HAVE NOT filed an ethics complaint against Nyle, but would not be surprised if someone does. I do not mean to sound pissy and angry, but am getting that way quickly. If so many have said that they would support the otta-seal on a ballot, WHY would Nyle not want to do it that way? If the prior board had worked with Mr. Brown two years ago, he supported the road improvement, in fact wanting asphalt, but wanted it based on each property's assessed value, as our laws are written, this could be a thing of the past already. I do feel that Nyle is dragging us all down a rabbit hole. I would not want to be a board member with him as he does not seem to follow rules and suggestions given to him, especially about not talking about (due to his home's value) and getting this done. I think many people are skeptical of the board as a whole, much due to Nyle's behavior. If he can afford to pave to his home, he could afford the % more on the ballot. I will continue making calls and seeking the documents I asked about, and what can and cannot be done on a ballot with the County of Deschutes, If it appears we can get this on a ballot for a reasonable amount of money (<$5000.00 +/-) I will see if I can raise that amount. I do not know who quoted $5000 to $12,000., but that would be ridiculous. Jim, I agree that Buckhorn needs work, however, if it was going to be Otta-Sealed as the whole project would have been done, WHY $49,k now? ~Kerry

We missed the meeting to attend another gathering that we were committed to. We just listened to the board meeting on the 12th of May. We do have a couple of thoughts and questions.
#1) It is mentioned in the meeting that the cost of getting the measure on the ballot would cost $5,000.00 to $12,000. Do you have the paperwork from when Janet Zuelke and Forrest Babcock were working on the measure, We are 100% positive it was nowhere near that amount. Do you have those records?
#2) It was also said that an assumption was made that the vote on any ballot measure would be (assumption) of registered voters. Is there any way that property owners not residing here, (who are likely gathering funds from their rentals and any increase in their taxes from this vote, which could possibly be used for tax write-offs) can vote on a ballot measure? None that we know of. So, does this mean you are back to thinking about just doing a vote of property owners that caused much of this uproar two years ago?
3) It is also mentioned that it had not been decided if we were going to take a split assessment, shared cost, or based on each individual property assessment. Did the county say that this was even a possibility? If yes, who did you speak with or where did you find that, if not, who is telling you that this is possible?
We personally have said that we support the road project, especially the otta seal, as we went and looked at it and liked it. However, we felt and still do, that it would be most fair if we (all our Panoramic Neighbors) paid for our own assessed value, not an equal share of the expenses. We have not been the only ones that have said this.
4) We would like to see this on the ballot as soon as possible and did not understand your explanations of WHY it could not be done. It does not sound like Mr. Brown has submitted a ballot measure, has he? The ballots would need to be ready by their mailing date of 10 October 2022. That would leave you and whoever wants to assist, if permitted, to work on this. If this could get done, and you would know if it passed within a few days, and certified within two weeks, you could save on the expense of BuckHorn and plan on this as a spring project.
